I’ve thought of a new crime in the cyber-age, a “Dangerous Drunk”. This is a prior restraint crime that perhaps shifts the burden of proof in an order to show cause [OSC] type proceeding where you avail yourself to the court and they are prepared to take you in. As an alternative, you defy the jurisdiction of the court and flee [like Snowden]. In any event, having skipped the OSC Hearing, you become a fugitive with an arrest warrant attached where the authorities can take you in upon capture.
Sample Case:
JUDGE BADMOODY: Mr. Rubens, you’re a dangerous drunk.
RUBENS: [Why is she doing this to me? If male judge, look downcast; LOOK DOWN]
JUDGE BADMOODY: Mr. Rubens, is there any reason that I should not incarcerate you for being a dangerous drunk in your neighborhood and around the world.
RUBENS: [Looks up confidently] Yes Your Honor, I’m sober. [Avoids Checkmate]
JUDGE BADMOODY: Well then you must be crazy.
RUBENS: I like the sunshine, your honor.
JUDGE BADMOODY: Well you know what happens when you get too much sunshine don’t you?
RUBENS: Get ‘touched’?
JUDGE BADMOODY: You’re plenty ‘touched’. You get BURNED Mr. Rubens. You get a sunburn and need medical attention. Now get out of my courtroom!
RUBENS: Thank you your Honor.
BAILIFF: Call the case of THE PEOPLE V. MOREFORD.
JUDGE BADMOODY: Don’t we have any more Orders to Show Cause?
CLERK: They haven’t shown up your honor.
JUDGE BADMOODY: Alright, let’s start the trial then.
BAILIFF: Call the case of THE PEOPLE v. MOREFORD
ATTORNEYS FOR PARTIES: [Attorneys take turns announcing their names out loud to the the court and the Parties they represent. Perhaps there’s more than simply one attorney for each Party present. Examples: ‘Don Lipscomb for the Defendant, your honor Your Honor’. {PEOPLE’S attorney annoyed she did not speak out first} ‘Harriet Wallbanger for the PROSECUTION, your Honor’.]
