@UCRegents v. #Bakke (1978) @wikipedia

Allan P. Bakke, an engineer and former United States Marine Corps officer, sought admission to medical school, but was rejected for admission by several, in part because, in his early thirties, he was considered too old. After twice being rejected by the University of California, Davis, he brought suit in state court. The California Supreme Court struck down the program as violative of the rights of white applicants and ordered Bakke admitted. The U.S. Supreme Court accepted the case amid wide public attention.

The case fractured the court; the nine justices issued a total of six opinions. The judgment of the court was written by Justice Lewis F. Powell, Jr.; two different blocs of four justices joined various parts of Powell’s opinion. Finding diversity in the classroom to be a compelling state interest, Powell opined that affirmative action in general was allowed under the Constitution and the Civil Rights Act of 1964. Nevertheless, UC Davis’s program went too far for a majority of justices, and it was struck down and Bakke admitted. The practical effect of Bakke was that most affirmative action programs continued without change. Questions about whether the Bakke case was merely a plurality opinion or binding precedent were answered in 2003 when the court upheld Powell’s position in a majority opinion in Grutter v. Bollinger.

1st Annual @TRADOC #MadScientistWritingContest #Deadline: The Ides of February.

Time management can be the difference. Or ancient languages. Ask kids BARRON’S age about the future they want and warn them of our past.

I’m done for the 1st annual and am fittingly fatigued.

I scheduled a few repeats to post all before Feb. 1, 2017 PT.

You done did good, but so did Troy, so did Troy.

Fences, a play by August Wilson (1983); a film by Denzel Washington (2016).

Re: Umpires have potential. Potential means, “Ain’t worth a shit yet.”–Sports Commentator jargon 1987.

WHITE GUY: I don’t like it…these cameras everywhere, and then they have other people that look and they look at the videos…

BLACK GUY: And they still don’t get it right.

WHITE GUY: Yeah! Why bother if you’re still gonna get it wrong! Who knows who’s in the booth in New Y–

BLACK GUY: [Concerted look, stopping white guy mid-sentence {you got bias? You a cracker?}]

WHITE GUY: [Oops.]

Watched #TheGetaway (1972) A Film by Sam Peckinpah last night.

I suppose it still is time to discuss womens’ “place[s]”.  Sally Struthers was used and ill-prepared for the Italian gunman.  Three years later, in Rollerball, A Film by Norman Jewison set in 2018, women were trophies and distractions. I have no idea what’s to come.

Ali McGraw was–maybe still is Mayor of Malibu.  Steve McQueen is dead. His last role a message? An Enemy of The People by #HenrikIbsen.

Happy birthday bloke!

I’ve got skin in the game today. Yesterday it was “It’s the ‘now’ I don’t want to face so I lay.  I’ll face it tomorrow but today’s today.”

Good on ya Mec!

A sick society that trusts in God deserves to get better or die.

Johnny Cash? Boy Named Sue?

It’s time boys.  Kick ’em in the nuts–they’ll be wearing cups soon.
